Clifton Williams was present for his cousin’s sentencing hearing at the Will County Court in Joilet, Illinois on July 23rd. Circuit Judge Daniel Rozak was in the process of declaring the sentence when Williams let out what a prosecutor in attendance called “a very loud, boisterous” yawn, which he said was an “attempt to disrupt the proceedings.”

Did he at least cover his mouth?

Either way, the judge wasn’t amused, and sentenced Williams to six months in jail for criminal contempt of court.

Judge Rozak is apparently not shy about handing out contempt charges.

The Chicago Tribune reports that he doled out more than 33% of all such charges in the 12th Judicial Court over the last decade. Others who have been charged included individuals whose cell phones rang during proceedings, and people who have audibly cursed while attending sentencing hearings.

After serving the mandatory minimum of 21 days in jail, Clifton Williams could apologize to the judge and be released—if the apology is accepted. His chance will come this Thursday.

For his sake, we hope he is well rested when he returns to Judge Rozak’s Courtroom.

    I hope he gets off. There was a 16-year old shot right after her father bought her a car for doing so well in school. My tax dollars should be paying for finding that girl’s killer, not locking up some poor sap who couldn’t hold his yawn in. This was completely uncalled for. Why couldn’t he get a stern warning before the book was thrown at him?

    I agree w/the judge – this country has gotten outta hand and it is about time someone put a stop to people who are discourtious, especially in the court room setting – yes there is freedom of speech(yawn) but there is a time and a place. He took a gamble and lost so now he has to pay the consequences.

    I am all for placing punishment when it is deserved this just seems insane to me coming in on the coat tail of the 30 day sentence that “Pro footballer” got for murdering someone while under the influence. The punishment should fit the crime not the punishment should fit how much you have in your bank acct

    Remember racist screamers, you dont go into a judge’s courtroom and then see how far you can push the judge’s patience (and then cry racism when the judge doesnt take that kind of garbage), especially when he’s given out 33% of the contempt of court charges in the past, its just plain stupid.

    Let’s just go along with the idea that interrupting a courtroom is punishable, which it is. Still, HOW does ANYONE justify putting a man behind bars for SIX MONTHS for making any kind of noise in a courtroom? I don’t care if the guy yelled at the top of his lungs, is 6 months, or even 21 days, even ONE day behind bars really justified?? You gotta realize that this man is being kept from his life, work, family, friends, EVERYTHING, all because he supposedly wasn’t “respectful.” Well let me tell ya something, it’s not the law to be respectful, and punishments should fit the crime. I think removal from the court room and even a fine would be suitable, not jail time. That’s just ridiculous. Maybe before you agree with this, you should think about how your tax dollars are going to imprison people for nothing more than yawning while a power hungry judge is talking.

    very clear and simple the judge does not believe in allowing his authority being undermined by somene who has no respect.there isnt any racism here nor is the judge being an asshole as it was pointed out so many times.when an individual yawns,it doesnt have to be a loud yawn.what i read was this individual was loud when he yawned.im sure if he kept his yawn to himself he wouldnt have had any problems with the judge.as i said before the judge simple doesnt want his authority undermined

A power trip… humm he has the power why trip on it. If I were the judge I would have asked the officer in the court room to go over and bonk him on the head with his night stick.     Don’t you know? Yawning and loud throat clearing are the new rude. When my brother wants to “one up” me he yawns in my face to show his displeasure. What a sweetheart! Other “friends” use lous throat clearing as a form of passive aggressive harassment. I guess the judge isn’t too out of the loop because he knows about these ugly forms of behavior.

    its hard to comment on something u dint witness.. but i think both sides of the party overdid their bit. the guy should’ve tried to control his yawning, and the judge shouldnt have gone to such an extent of sending him to jail, and that too for 6 months. yeah sure the guy probably deserved sum sorta punishment for being disrespectful, however the judge should be the wiser one.

    I think this is stupid. This Judge thinks ge is above the law. I would bet if you followed him around for a day, he would get caught doing all sorts of things that he can get away with because hes “The Judge”

    The types that act that way are always the ones who think they are above others and the rules don’t apply. Could be wrong but I doubt it.

    Why not warn him first, to give him six months with no warning is unfair and I hope the judge goes to hell.

    This fellow was disrespectful in the court room, however, sentencing him to jail is quite a severe punishment for yawning. Why not sentence him to Community service for a couple of months? Cleaning pubic washrooms would be humiliating, perhaps make him think twice about disrupting court room procedures in the future. I wouldn’t be so critical of the Judge since I wasn’t in the court room at the time, I don’t believe anyone should go into a court room with attitude, that is the wrong place to show off as this fellow found out.

I wasn’t there to analyze the situation but any loud easily controlled behaviour was definately an attempt to disrupt the proceedings. Perhaps there is some history between the judge and the charged. He might think twice next time but I doubt it.

    Jail time is to much for a Yawn. I can understand a fine to ensure order, but six months in jail is way out of scope for the crime of annoying a judge. The system needs to drum out the abuse of power as it is a disgrace to the country. I can see why people hold the system in contempt! This type of power abuse will lead to violence against authority. The judge had other options more suitable to the crime. There are all kinds of crimes occuring and people receiving less punishment than that yawn. This is shameful.

    I think It’s absolutely ridiculous, never heard of such thing.
    I’m from Canada and I personally know people that deal weed and crack of large amounts and they’re out of jail within 2-3 months, ususally with weed you just get a fine.
    The guy should have some respect for the court and people around him but to lock him up in jail, wasting your (taxpayer) money on such a petty thing. Only in America lol

    This was obviously a lack of manners and a deliberate attempt at disrupting the courtroom.
    If that was my son I would have smacked him.

    Now – if the yawn was real – he really should have covered his mouth and the judge should have no issue with that.

    However, this was not the case.

    Lack of Respect for the Courtroom and the Judge = Jailtime

    Next time he is in court I betcha he will think twice.

    Noone knows anything truly about this incedent. Was it a first offense? Did he have a rap sheet a mile long? Does he even have a family he supports or a job? There is no charge for yawning or making loud noises. The only usable law is contempt and has to cover a lot of indescetions. At least he doesnt have to worry about eating!     That’s ridiculous unless it was an absolutely fake yawn. Yawns are notorious for happening at inopportune times because yawns are an indication of a change in the brain, often between wakefulness and sleep, but potentially of others as well.

    If he was faking it, six months for a yawn is still pretty harsh. If he wasn’t, it’s preposterous.

    It is unfortunate for Mr. Williams placed himself in a position to be punished for inappropriate behavior in the courthouse of his jurisdiction. But ALL spectors MUST be held accountable for conduct that can compromise order and discipline in the courthouse. No sleeping(in his case, yawning)in the courthouse is the rule, not the exception.

    A rich man will never know the feelings of a person living check to check. A well establish family will never know the feelings of a homeless family. No matter how much we try to imagine how it feels to be in their position we will never know the true pain that person feel. If you never experience racism or been denied equal opportunity you will NEVER know the feeling of that person. Some of you that never felt that type of pain need to keep your mouth close when the people that experience it every day express their feelings. Racism is alive and kicking butt every day. True we don’t know the thoughts of that judge. We can only look at his past cases and view the sentencing of black and white people and the type of punishment the judge has given them to determine if he is giving people of color a harder sentencing. I had to deal with the BS all my life plus my kids had to deal with it at the so call best elementary school in my town and you want to know why. That teacher could not deal with the simple fact that my child was the only black kid in class and the smartest. This happen less than 5 years ago and some of those kids called him names. Who do you think are teaching those kids? The truth is the truth some people need to wake up and deal with it. Stop getting mad and upset because some people of some race hate other people of other races.

    Clearly the young man in question was showing his contempt for the process whereby his cousin was being sentenced and his disdain for the judge presiding over the process. The judge does not have many tools available to deal with such obvious and intentionally disruptive behavior. The young man believed his behavior was immune from citation or he wouldn’t have engaged in so blatant a display. It was contempt and was dealt with as such. Why is this so difficult for so many of you? This is not about race or power hunger. This is about bad behavior.

While I believe respect is not an option in the courtroom, the judge is NOT GOD, a yawn is an involintary act kind of like a sneeze, when it happens you can’t stop it.     Personally, I think that judge abused his power and wasn’t concerned about the man “disrupting the proceedings”, but put him away in an attempt to gain some “pride”. He possibly had his ego harmed if his courtroom was seen as mundane and boring. But that’s only one theory. There are endless possibilities as to why the judge reacted the way he did. But one thing remains that, from what I read, the judge failed to do: a proper hearing. Any case dealing with prison or the justice system needs a proper hearing. Was a jury involved? From what I can tell, no. Whether or not the judge truly was justified in his assumption about the “criminal”, it was an unfair hearing.

    Up to 6 months for a yawn? yeah, the sentence is definitely uncalled for and it’s ridiculous. What’s next? 6 months for coughing and sneezing? A reasonable and just judge would have given a stern warning first before passing out such a sentence. Clearly, the judge is on a power trip and needs to stroke his ego.

    This judge sounds like an insecure idiot.

    There is no reason in the world for a sane human being to have to act like an over-reacting, possibly racist, idiot with no common sense. He seems to have a pattern of over-reacting, threatening, and intimidating people over their trivial behavior in a courtroom belonging to the people of Illinois (not him). The only reason for him to behave like that is an innate insecurity about his ability to do his job.

    It doesn’t look like he can do his job in a fair and non-partial fashion. Perhaps a few refresher courses on race, civil liberties, and physiology are in order (yawns are involuntary reflexes). Oh yeah, he may need a psych eval., too.

    I don’t know if Chicago residents can recall judges, but really, this guy should give up his job to someone who can actually do it!

    It has been over rated and controlled by power hungry people.
    Whether the man did it on purpose doesn’t matter the judge and all judges are supposed to uphold the rules, laws, and due process through equity.
    When judges take their position of power and thwart it to suffice their own feelings (emotions) because she/he wants to or can and abuse their power, as they all seem to do with no repercussions of her/his actions, they are the ones who deserve to be judged by the public.

    It is about time “We The People” take back some of our rights, our Congressional Constitutional Rights and show all the courts throughout the United States Of America that we won’t tolerate their abuse of power any longer.
    I say all judges need to go back to Law School and re-learn what their jobs were originally meant for. What they do now is sit behind their black robes hiding behind the idea that they can do anything they want and to whom they want.

    The meanings are lost behind the public’s fear of being judge.

    its pretty hard to hold in a yawn, especially if you didnt get much sleep the night before. And lets face it, criminals aren’t the brightest of people, nor are they known to respect authority. but if he REALLY wanted to disrupt the proceedings im sure he could have done worse. it was just an error in judgement on his part not to turn away or cover his mouth, but i dont think it warrants a 6 month sentance. the judge was clearly on a power trip.
